What is an appellate brief?

An appellate brief could be the most important written document in your life if you are involved in a Florida divorce or child custody appeal.  The appellate brief is an “argument on paper” about why the divorce court judge’s decision was correct or incorrect.  Unlike in a trial, where witnesses testify and lawyers argue issues to a judge inside of a courtroom, most of an appeal takes place only through written documents called briefs that are sent to the appellate court judges to explain why the divorce court judge’s decision is correct or incorrect.
