Florida Divorce & Child Custody Appeals| Dividing Property

A Florida Divorce & Child Custody attorney provides answers to the most common questions when considering appealing your divorce or child custody case.

What is a Florida divorce court judge supposed to do when it comes to dividing property?  Are there mandatory findings that have to be written into the judge’s property division order?

Every property division/equitable distribution order issued by a Florida judge is supposed to have specific written findings detailing: (1) identification of marital and non-marital assets; (2) valuation of marital assets and liabilities; (3) designation of which spouse will have each marital asset or be responsible for each marital liability after the divorce; and (4) any findings necessary to allow the parties or the appellate court with the divorce judge’s rationale for dividing the marital assets and liabilities.

Also, if the divorce Florida judge gives an unequal distribution of marital assets or liabilities there has to be specific findings to support the unequal distribution.
