Florida Divorce Appeals | Premarital Assets & Property Division

A Florida Divorce & Child Custody attorney provides answers to the most common questions when considering appealing your divorce or child custody case.

The divorce judge gave my former spouse some of the value of my premarital assets.  Was that a mistake?

It might have been.  Generally, assets owned before the marriage cannot go to the other spouse as part of a divorce case.  That said, if the premarital asset was mixed with marital assets, or the value of the pre-marital assets was enhanced with marital labor, than it may have been correct for the divorce court judge to have awarded your spouse a portion of your non-marital assets.
