What is a motion for “en banc review”?

 A motion for “en banc review” is a request for the entire panel of judges to review the appellate court’s decision.  In most cases, there will be a “panel” of three judges that decides a divorce or child custody appeal. A motion for en banc review is a process of requesting for all judges at the district court (usually at least 10 judges), to review the appellate panel’s decision.

 An en banc review of a Florida divorce or child custody case is rare.  If you desire to request an en banc review, your attorney must certify in the motion that the issue of your case is of “exceptional importance”.
